Trapshooting University WAIVER AND RELEASE OF LIABILITY

THIS IS AN IMPORTANT CONTRACT WHICH GIVES UP CERTAIN RIGHTS. READ IT CAREFULLY.

    In consideration of Trapshooting University (“TSU”) furnishing services, equipment, and/or the facilities and in consideration of my participating in clay shooting and other TSU activities (the “Sport”), I agree as follows:

    I fully understand and acknowledge that:

    1. There are risks and dangers in my use of sports equipment (guns, safety equipment, etc) and my participation in the Sport, including:
      • risks from handling firearms;
      • risks from being near others who are handling firearms;
      • risks of injury or death from ammunition and shots from other guns;
      • risks of injury from recoil or misfiring of the firearm I am using;
      • risks that exist from tripping, falling or otherwise being injured on the property of others.
    1. My participation in the Sport, use of Sport equipment, and/or presence at TSU facilities may result in personal injury, death or other ailments that could cause serious disability damage to or loss of personal property.
    2. These risks and dangers may be caused by mechanical failures, or by the negligence of other participants, or by the action or inaction of TSU, its employees or agents, or by accidents, breaches of contract, forces of nature or other causes. Risks and dangers are inherent in the Sport, and may arise from foreseeable or unforeseeable causes.

    Recognizing and accepting all of these risks and dangers, I, on behalf of myself, my family, heirs, executors, administrators, representatives and assigns, assume all risks and dangers and all responsibility for any losses and/or damages which result from my participation in the Sport or my presence in or on TSU facilities.

    I, for myself, my spouse, family, heirs, executors, administrators, legal representatives, and assigns, hereby release, waive, discharge and exonerate, and agree not to sue, Trapshooting University, and its officers, shareholders, directors, employees, and agents (collectively, “Releasees”) from any and all claims actions or losses for injuries, property damage, death, loss of services or other, arising out of my participation in the Sport or my presence in or on TSU‘s facilities, whether due to the fault or negligence of Releasees, circumstances beyond Releasees’ control, or any other cause.

    I HAVE READ THIS RELEASE AND WAIVER, AND I UNDERSTAND IT.

    IT IS MY INTENTION TO RELIEVE TSU FROM LIABILITY FOR INJURIES, PROPERTY, DAMAGE, OR DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSES.

    I HAVE ALSO READ, UNDERSTOOD, AND WILL FOLLOW THE PROPERTY OWNERS RANGE RULES and SAFETY PROCEDURES.

    INTENDING TO BE LEGALLY BOUND:

    In consideration for the minor identified below being permitted by Trapshooting University (TSU) to enter the premises of TSU and/or to participate in any of the activities of TSU, including the handling and firing of guns and all related facilities and services of TSU, I agree, for myself and on behalf of the minor, to accept all of the terms of the Waiver and Release of Liability of WCGC. 

    I further agree to and do hereby waive, release, and indemnify TSU relative to the presence and/or participation of the minor on or in the activities of TSU.

    The undersigned parent, guardian, or custodian of the above minor, for himself/herself and on behalf of said minor, hereby stipulates and agrees to:

    • Save and hold harmless, indemnify, and forever defend Trapshooting University, its owners, officers, agents, employees, and volunteers (Releasees) from and against any claims, actions, demands, expenses, liabilities (including reasonable attorneys fees), asserted by, for, or on behalf of the minor; whether any such claims, actions, demands, expenses, or liabilities may be caused by the action or inaction of any Releasee or by any other cause or circumstance; which may be made or brought by said minor or by anyone on behalf of said minor, as a result of or relating in any way to said minor's participation in the activities of the TSU or his or her use of the property and facilities of TSU.
    • I, for myself and on behalf of said minor, further agree not to sue the TSU as a result of any injury, paralysis or death that said minor suffers in connection with his/her participation in the activities of TSU or presence on TSU property.
